Aerial Work with Aircraft and Helicopter
In the case of aeroplanes and helicopters, with the application of Commission Regulation (EU) 965/2012 of 5 October, a responsible declaration regime has been established for specialised commercial operations and specialised non-commercial operations with complex powered aircraft.
In addition to the declaration, for operations considered to be specialised high-risk commercial operations, an authorisation is required.
Article 5(6) of Regulation (EU) 965/2012 provides that operators may only operate an aircraft for specialised commercial operations in compliance with Annex III (Part-ORO) and Annex VIII (SPO), which set out the requirements to be met by the operator as an organisation and the specific requirements for the operation and equipment of aircraft engaged in such operations respectively.
The use of an aircraft to perform this type of operation requires the approval of the MEL in advance, in accordance with requirement ORO.MLR.105 of Part-ORO.
In the specific case of high-risk specialised commercial operations, it is therefore necessary to obtain an authorisation to carry out high-risk operations in accordance with requirement ORO.SPO.110.
Once the high-risk authorisation has been obtained, the operator shall submit a declaration of compliance in accordance with the requirement of ORO.DEC.100.
Notwithstanding the above, specialised operations carried out with aircraft complying with the criteria set out in Annex I to Regulation (EU) 2018/1139 shall not be covered by Regulation (EU) 965/2012, the national legislation being applied in any event.
Furthermore, and until 21 April 2017, Regulation (EU) 965/2012 shall not apply to specialised operations with balloons and sailplanes pursuant to the Resolution of 16 February 2016 of the Directorate of the State Aviation Safety Agency.
