Operating licences

The applicable legislation for obtaining an operating licence is Regulation (EC) No 1008/2008 of the European Parliament and of the Council of 24 September 2008 on common rules for the operation of air services in the Community (D.O.U.E. No. L 293 of 24 September 2008), as well as national implementing legislation, Order TMA/105/2020 of 31 January 2020 laying down rules for the granting and maintenance of air services licences.

To facilitate the preparation of documentation, EASA has developed the “Guide to obtaining an operating licence for the provision of air transport services” with the conditions to be met, the list of documents to be provided by the applicant company, the model spreadsheets for the presentation of the business plan for the provision of air transport services, as well as the valuation criteria to be applied to the analysis of the information received.

Criteria for determining the concepts of “Property and control”

Type A companies

Type “A” licences: Allow the operation of air passenger, cargo or mail services, in exchange for remuneration or rent.

Type B companies

Type “B” licences: Allow the operation of air passenger, cargo or mail services, for remuneration or rent, exclusively with aeroplanes with a maximum take-off weight of less than 10 tonnes or less than 20 seats.
