Package Travel

A package is a package that includes at least two different services (e.g. transport and accommodation) sold together at a total price.
These types of trips usually include, in addition, other tourist services such as excursions or car rental, and last more than 24 hours or include at least one night of stay.

If the problem is due to a cancellation or incident of the flight, you can complain to AESA, because Regulation (EC) 261/2004 applies.

If the cancellation affects the entire package (for example, the agency cancels the entire package or changes the conditions of the trip), the claim must be submitted before the consumer or tourism authorities of your autonomous community, which are competent to resolve this type of incident.

Legislation

The rights of travellers are regulated by Royal Legislative Decree 1/2007 of 16 November 2007 and by Royal Decree-Law 23/2018 of 21 December 2018.

This regulation includes:

  • The conditions for cancelling or modifying a package.
  • The right of the traveller to desist before the start of the trip.
  • The responsibilities of the organizer (usually the agency) and the retailer (who sells the trip).

 Remember:

  • Always check the terms of the package travel contract before hiring.
  • If an incident occurs only on the flight, first complain to the airline and, if you do not receive a response or are not satisfied, you can file your claim with AESA.
  • If it affects the entire holiday package, contact consumer or tourism organizations.
