General framework

AESA, in accordance with its Statute (Royal Decree 184/2008) and since the publication of Royal Decree 160/2023, has assigned the following powers in terms of control and monitoring of noise pollution of airport infrastructures within the competence of the General State Administration:

  • Supervision, inspection and sanctioning of the obligations arising from the application of Law 37/2003 on Noise and, in particular, the monitoring of action plans and monitoring of compliance with noise levels applicable to airports.
  • Under Regulation 598/2014 (EU) of 16 April 2014, those related to the establishment of rules and procedures with regard to the introduction of noise-related operating restrictions at airports within the so-called ‘balanced approach’.
