Processing of changes

The processing of changes is regulated in article 28 of RD1070/2015, in article 5 of RD1189/2011 and in article 7 of Law 21/2013, without prejudice to what may be established by the competent body of each autonomous community.

The introduction of a modification that may affect the airspace compatibility, the environmental procedure, the authorisation of establishment and/or the authorisation to open to traffic must be communicated to the competent body of the Autonomous Community.

Depending on the characteristics of the change, a new airspace compatibility report or certificate, a new environmental procedure, a new resolution of compliance with technical standards, a new resolution of authorisation of establishment or a new resolution of opening to traffic may be required. 

If the modification affects the technical safety standards, it must be communicated to EASA through the competent regional body at least one month in advance. After receiving the notification, EASA has 20 days to decide whether it is necessary to modify the previous decision certifying compliance with the technical safety standards.

In case the changes affect key elements such as the runway operational category, the aerodrome configuration or the determining aircraft, among others, a new resolution will be required.

The communication of these changes must include documentation demonstrating compliance with the technical standards. If EASA considers that the modifications need to be verified, it will have up to six months to issue a decision; if no decision is taken within this period, compliance with the safety rules will be deemed to have been rejected.

The Autonomous Communities of Aragon, Catalonia, Madrid and Valencia have defined their own procedure for processing changes, and should therefore refer to the information published by the competent body of the respective Autonomous Community.
