General framework

Restricted-use aerodromes include infrastructure for ultra-light aircraft, hydrofields and heliports, other than aerodromes for public use as defined in Article 1(3) of Royal Decree 862/2009. (Article 3b of Royal Decree 1070/2015): Aerodromes for public use are civilian aerodromes where commercial, passenger, freight and mail transport operations, including aerotaxis, can be carried out. 

Until now, it was AESA that issued the authorisations for the establishment and opening to traffic of restricted-use aerodromes. However, as a result of the question of competence that has arisen, it has been determined that competence in airport matters must be exercised by the autonomous communities that have assumed it in their statutes of autonomy. Consequently, the State must inhibit itself in favor of the autonomous communities so that they are the ones to resolve. To this end, the mechanisms for cooperation and collaboration with each of them are being studied.
